Clean Energy Technology

The progress of civilization has always been measured by milestones — from the development of internal combustion engine in the 19th century to the silicon chip in the 20th century, innovation has played a critical role in the growth and sustenance of the human experience. The 21st century will produce breakthrough in clean technology and renewable fuels. Our improving understanding of the long term impact of fossil fuel consumption, industrial waste, and pollution has created a thriving industry centered around the application of science to produce cleaner, more efficient, and sustainable ways of living.

O’Melveny is committed to providing comprehensive legal services to companies and investors driving the development of technology in the clean tech and renewable energy sectors. We offer a unique combination of applicable corporate, intellectual property, and regulatory law knowledge and geographic coverage in the world’s major centers of clean energy innovation: Silicon Valley, China, and Europe.

From early stage venture capital financing to protection and commercialization of intellectual property, to mergers and acquisitions and initial public offerings, our Clean Energy Technology lawyers are dedicated to supporting the forward progress of science and commerce in this important field.

Key Facts

  • Our experience covers solar, wind, geothermal, biomass and synfuels, waste-to-energy, landfill gas, coal gasification, and zero emission vehicle projects and includes all related regulatory licensing and approval matters. Our lawyers are engaged in early stage and mature alternative energy finance and M&A transactions including the successful IPO of China Sunergy Co., Ltd on the Nasdaq Global Market exchange. Additionally, our intellectual property staff regularly works on patent prosecution and protection with regard to alternative energy technology.
  • O’Melveny’s team provides fund formation and transaction services for carbon projects. We advised Impax Group plc on its mezzanine and equity investments in European renewable energy and related sectors, as well as in the successful launch of Impax New Energy Investors LP, a private equity fund targeting investments in projects in the renewable energy and related sectors. This fund aims to exploit the significant investment opportunities in Europe arising from the legally binding European targets for renewable energy supply.
  • Our China practice is recognized as a market leader among U.S. firms. Unlike many of our competitors, our practice is predicated upon strong knowledge of local law and significant on-the-ground resources. Our track record of representing some of the world’s leading corporations, investors, and financial institutions is testament to the strength of that platform. Recently named “China Practice of the Year” by Asian Legal Business, our China team specializes in advising multinational clients on their undertakings in the rapidly growing China market.
  • We serve the European market out of our offices in London and Brussels — two of the region’s key financial and regulatory hubs. Our London office — recently awarded the “Best U.S. Law Firm in London” recognition by Legal Business — offers top-of-class counseling relating to mergers and acquisitions, corporate finance, and competition law matters, and particular expertise related to private investment fund activity. Our practitioners in Brussels operate at the EU’s political and legislative center, and focus on EU and regional competition law as well as trade and sector regulatory matters.
  • In 2007, O’Melveny launched its "Green Office Initiative" to conserve resources and reduce the carbon footprint of its 14 offices around the globe. Three significant achievements of this initiative include being among the first law firms to achieve nationwide compliance with the ABA-EPA Law Office Climate Challenge Best Paper Practices program, attaining 100% usage of wind power in our New York office, and the recent move of our San Francisco office into a new building that achieved Gold certification through the US Green Building Council’s LEED program for commercial interiors, making O'Melveny the first law firm to have achieved a Gold rating—the next-to-highest rating possible in the LEED scale—for renovated space in an existing building.
  • O’Melveny has embarked on a program of charitable contributions to reduce its carbon footprint. For example, since 2006, we have contributed to the Rainforest Alliance (RA), an international nonprofit organization that leads efforts to certify sustainable forestry, agriculture, land use, and business practices. We also work with RA on numerous pro bono projects, including international policy affecting the use of forests and carbon sequestration to create carbon credits. In addition, we represent pro bono client Forest Stewardship Council in various certification and carbon sequestration projects.
  • Our lawyers have been honored in Chambers USA, International Who’s Who of Business Lawyers, The Best Lawyers in America, PLC Which Lawyer?, and Law & Politics Media Inc. Chambers USA 2009 states that clients call on our team for “matters where we [clients] need substantial firepower.” Chambers also cites our experience in the climate change and environmental sectors.
