Patent and Technology Litigation
Because intellectual property protection is so important in today’s technology- and information-based economy, companies increasingly find themselves in court enforcing, or defending, their patent and technology rights. As a result, it is crucial to have experienced trial lawyers who are well-versed in the intricacies of patent and technology law and policy and can explain and distinguish complex scientific principles to judges and juries. O’Melveny’s patent and technology litigators have the forensic and technical skills, and the industry and professional experience, needed to tackle the most demanding intellectual property disputes. For decades, we have prevailed in must-win cases, including our recent representation of toy train maker Lionel LLC on appeal, reversing a US$40.8 million jury verdict and rescuing the century-old company from bankruptcy. We litigate patent and technology matters in forums around the nation, both at the trial and appellate levels, including Section 337 proceedings before the International Trade Commission. We also coordinate and supervise parallel proceedings outside of the United States, to resolve intellectual property controversies that increasingly traverse countries and continents.
Key Facts
-
Through education and experience, our lawyers have acquired deep technical and business sophistication in a broad array of fields, including computer hardware and software, electronics and electromechanical systems, scientific instruments, medical devices, biotechnology, and the chemical arts, among others.
-
We provide comprehensive and coordinated representation on the most complex patent and technology matters, including multifaceted cases that lie at the intersection of patent and antitrust law, such as our representation of Advanced Micro Devices, Inc. in what is believed to be the largest private antitrust action in US history, and our defense of Top Victory Electronics, one of the world’s largest manufacturers of digital televisions and computer displays, against claims that implicate the technology used in every LCD television sold in the United States.
-
We offer imaginative solutions to complex problems. For example, we successfully defended an advanced aeronautics and space systems technology company in a patent infringement dispute involving attitude control systems for space satellites by utilizing an invalidity strategy that involved the reexamination of the patent-in-suit and resulted in the invalidation of all patent claims and subsequent dismissal of the case.
-
We are regularly asked to take over difficult or complex representations mid-stream, and are frequently successful in changing the course of cases that have been handled by other counsel. This was the situation in our representation of toy train maker Lionel LLC, in which we successfully appealed a multimillion-dollar jury verdict on trade secret claims that had plunged the company into bankruptcy.
-
Among other accolades, Chambers USA has repeatedly recognized our strong intellectual property practice, noting that the Firm is “renowned for its IP expertise,” and adding that “[c]lients appreciate ‘the high level of service, commitment and responsiveness’ demonstrated by [our] lawyers,” who “'understand business needs and work hard to get the right results.’"
-
Chambers USA (2008) further singled out O’Melveny patent and technology lawyers that it describes as “exceptionally responsive;” “fantastic;” and “not to be underestimated.”
-
The Legal 500 (2007 and 2008) described our practice as “sophisticated and confident,” adding, more specifically:
-
The Firm adopts a multifaceted approach to trade secrets that cuts across the intellectual property and technology, labor and employment, global enforcement and corporate departments.
-
Uniquely, O’Melveny’s intellectual property and technology practice is integrated, rather than being divided and subdivided around substantive areas of law, as is the case in other firms. “Thus, the [F]irm’s lawyers are able to approach intellectual property issues from all angles.”
-
Indeed, O’Melveny’s lawyers are “noted for their breadth, as well as their depth, of knowledge. In addition to being fully up-to-date with current legal developments, they have a rare knowledge of more arcane areas of law.”
-
Clients are “particularly impressed with the high levels of technical expertise” within the Firm—O’Melveny retains several technical experts as full-time members of its team -- and "are quick to appreciate that the firm 'brings a strength to the table that not many others can match.'"
-
One client said, “They have breadth of expertise beyond the law, which makes them a valuable asset. Their technical expertise sets them apart. That said, their practice transcends industry boundaries.”
